Judge Joseph R. Goodwin of the United States District Court in West Virginia presides over not one multidistrict litigation, but four, all involving transvaginal mesh lawsuits.

Judge Carol E. Higbee, who presides over a sixth transvaginal mesh multidistrict lawsuit in New Jersey, set  trials to begin in November.

The Mirena IUD  is a small, t-shaped, plastic  birth control IUD that is inserted into the uterus. It prevents pregnancy by releasing a low dose of levonorgestrel (a synthetic progestin hormone) directly into the uterus. Mirena was approved in 2000 as a contraceptive, and its approval was expanded in 2009 for the treatment of heavy menstrual bleeding for women who desire to use an IUD as contraception. In 2009, the U.S. Food & Drug Administration (FDA) issued a letter to Bayer Healthcare Pharmaceuticals after the agency found that one of its Mirena promotions overstated the positive uses of the device and minimized its risks. Among other things, the Mirena FDA warning letter cited marketing claims emphasizing  Mirena will improve a woman’s sex life and help her “look and feel great." Bayer is known for it's advertising to women for freedom with their contraceptive products as we saw the same thing with Yaz. Yaz now has 1000's of lawsuits filed for blood clots and Bayer has begun the first round of settlements for Yaz.

A transvaginal mesh is just another name for a vaginal mesh or a bladder sling, They are all Prolene mesh inserted through the vagina for organ prolapse or urinary incontinence. If you have been implanted with a prolene mesh it is a polypropylene Knitted Mesh which is   composeed of monofilament yarns, which were  engineered for the manufacturing of textile fabrics.These are used for hernia mesh , stress urinary bladder slings, and transvaginal prolapse supports.  Polypropylene mesh is marketed under the name Prolene by Ethicon.  Transvaginal polypropylene mesh is  used in the support of pelvic organ prolapse amd urinary incontinence to reinforce a weakened vaginal wall or pelvic floor muscles and ligments that can no longer serve as an organ support system. Great in theory, but not holding up in many women.

The Transvaginal Mesh Problem

It is now shown that the vaginal mesh used by urologogical surgeons, urogynecologists and gynecologists to repair pelvic organ prolapse, cystocele or rectocele and to treat urinary incontinence has serious complications. The manufacturers appear to have been less the honest about the potential complications then they lead us to believe and women are filing lawsuits to obtain compensation for their injuries. The trial dates have been set and the proceedings have begun as part of a massive multi district litigation. Deposition date are being set and the long road to win compensation for injustices to women has begun.

One of the big  problems for women has been finding doctors who understand the nature and scope of the problem and are willing to help women with mesh removal. This mesh was supposed to be permanent.We have been told  that doctors have been insensitive to women  and telling them that estrogen creme will fix the problem  or that their problems are mostly in their head. New Vaginal Mesh MDL Update | Vaginal Mesh Lawyers

On August 20, Chief Judge Joseph R. Goodwin issued the Order authorizing the Master and Short Form Complaints in the U.S. District Court for the Southern District of West Virginia.
Those complaints can now be filed by plaintiffs in the federal court cases involving:

    American Medical Systems, Inc. (MDL No. 2325),
    Boston Scientific Corp. and Ethicon, Inc. (MDL No. 2326),
    Ethicon, Inc. (MDL No. 2327) and
    C.R. Bard, Inc. (MDL No. 2187).

According to the Order, the purpose of the new complaint form is to eliminate delays associated with transferring cases filed in other federal district courts, to promote efficiency and to accommodate plaintiffs who wish to bring claims against defendants in more than one pelvic repair system MDL.
“The direct filing and short form complaints will help to streamline the process and make it more convenient for both the plaintiffs and the defendants to move forward with this important litigation, especially when a case involves multiple implants sold by different defendants,” said Henry Garrard, managing partner of Blasingame, Burch, Garrard & Ashley, P.C.
Garrard serves as Plaintiffs’ Coordinating Co-Lead Counsel and as a member of the Executive Committee for all four transvaginal mesh MDLs. His law firm partner, Josh Wages, serves on the Plaintiffs’ Steering Committee for the four MDLs.
Additionally, Garrard is the Co-Lead Counsel for the Plaintiffs in the Bard MDL. The first trial date in the Bard MDL is set for February 5, 2013.
“If a plaintiff was implanted with multiple pelvic mesh products sold by more than one of the defendants in the four MDLs, the complaint will be filed in the MDL associated with the first defendant named in the Short Form Complaint,” Wages explained.
“By filing a Short Form Complaint, the plaintiff adopts the factual allegations and applicable legal claims set out in the longer, more detailed Master Complaint.”
Additionally, the Short Form Complaint may be filed directly in the Southern District of West Virginia instead of first being filed in a local federal district court.
The Master and Short Form Complaints for the pelvic repair product MDLs pending in the Southern District of West Virginia are available on the Court’s website, http://www.wvsd.uscourts.gov/. It is imperative that anyone filing cases directly in the MDL use the forms available on the court’s website, Garrard said.
The products at issue in the litigation are transvaginal mesh devices that were implanted in the female plaintiffs’ pelvic region to reinforce the vaginal wall for pelvic organ prolapse (POP) repair and / or to support the urethra or bladder neck for stress urinary incontinence (SUI) treatment.
The plaintiffs allege that the transvaginal mesh products were defectively designed and marketed. They claim to have suffered severe physical and emotional injuries due to a variety of complications, including pain,

FDA continuing to review vaginal mesh implants

According to a Los Angeles Times report this month, the U.S. Food and Drug Administration has released an updated warning focused on surgical mesh that is implanted into women to help strengthen their vaginal tissue.

The FDA was quoted as saying that they have conducted a review of literature and reports that show little evidence that the vaginal mesh implants help pelvic organ prolapse. Not only did the reviews find little advantage to using the mesh implants, but they also found numerous risks.

The report states that in September the FDA held an expert panel meeting to discuss the future of the product. Right now, it’s estimated that around 75,000 women who used vaginal mesh were treated for pelvic organ prolapse.

Warnings began to pop up concerning the vaginal mesh in 2008, mainly because of numerous reports which began to arise after 2005. According to the Times article, the FDA warned doctors to get special training in the placement of mesh. Since the 2007 FDA warning, there’s been an influx in complaints relating to prolapse repair.

According to the article, medical devices are often cleared without the requirement of clinical trial data. With these limited restrictions, a number of different products which are considered similar to other ones can be approved for selling.

The FDA is set to continue overseeing these vaginal mesh implants in all forms, to see if they may run the same level of risk. The agency has been under criticism for a few years due to the approval process for medical devices

Please let me know what your surgery outcome was.  I am currently interviewing surgeons to remove most or all of my mesh.  Though I do not have exposed mesh, I have severe nerve damage from the mesh becoming detached 2 weeks after implant and falling on a large nerve area.  All the area is damaged, numb and I have severe pain there.  I am on Neurotin all the time.
I am so dissappointed in the physician that did this surgery, but I am also concerned now about selecting a new physician.  I alread spoke to one who admitted he cannot help me. EVidently it is far easier to place the mesh, but it is entirely a different thing to remove it. My physician said it could not be done.  If I don't get rid of this, I will never be able to be normal.  I have been unable to have relations with my husband now for nearly 7 months.  My vagina has altered since the mesh was placed and there is a large enough obstruction to have caused a cessation in intercourse.
I am frustrated, upset, and tired of talking to doctors, looking on the internet, and hearing, "Oh, yes, we do this".  I don't have any idea who I can trust.

Boston Scientific issued a Class II recall of its Pinnacle pelvic floor repair kit  over the potential for the needle to detach from the mesh during placement. The device may expose patients to unnecessary risk without offering clinical benefit above safer options.

The product is used to treat pelvic organ prolapse, which occurs when internal organ support structures become so weak or stretched that organs, like the uterus, bladder or bowels, sag from their normal position and bulge or prolapse into the vagin
