Judge Joseph R. Goodwin, the judge overseeing the five vaginal mesh MDLs in the U.S. District Court for the Southern District of West Virginia, called a status conference on December 6, 2012 to announce that the first three bellwether trials have been scheduled to start in December 2013. These three bellwether trials all have different mesh manufacturers as defendants. The first case to go to trial names American Medical Systems (AMS) as defendant; the second trial will be against Ethicon; and the third will be a Boston Scientific lawsuit.

Diane and Paula have similar stories about vaginal mesh  they both had TVM implanted for incontinence and they are still experiencing "issues." They aren't suffering the agony of eroded mesh like so many other women, but they believe it's just a matter of time. And both women want to warn others not to have incontinence or pelvic organ prolapse treated with a transvaginal mesh surgical procedure.

 

Transvaginal Mesh: Two Cautionary Tales"I was having a lot of incontinence problems starting in my 30s," says Diane (not her real name). "When I exercised or coughed I would have a little leakage and it got to the point where I had to wear pads or even change my underwear. So on my gynecologist's advice, I had a transvaginal mesh implant when I was 56, two years ago."

Diane had the surgery at the University of Florida Medical Center, where they specialize in these issues. She was sent home that same day (surgery is on an outpatient basis) and immediately noticed some leakage around her catheter.

"As soon as the catheter came out I had the same incontinence problems so obviously the procedure was a failure," says Diane, "and there is still an issue when I sneeze, even after having another surgery last May, with a different kind of mesh."

But the issue of greater concern for Diane is whether or not the mesh will eventually erode. After reading online and watching on TV about so many women with horrific TVM experiences, it goes without saying that anyone with this mesh would be worried.

"Although I am concerned, there is nothing I can do about it," Diane says. "Besides, there are enough things in life to worry about, so if it becomes an issue then I will do something about it." However, she did file a complaint with an attorney for two reasons: she had to go through a second surgery, and she believes the TVM manufacturers should take responsibility.

"I am lucky that I am not having serious problems, but this mesh could still erode…"

Paula had a hysterectomy and soon afterward, she would have a "little leakage" every time she coughed or laughed. About five months ago her gynecologist of seven years asked Paula if she wanted her problem fixed. So she had the TVM implant at the outpatient clinic.

"Now my problem is worse," says Paula. "When I try to urinate, I push and it's like my bladder locks up. I have to completely relax and it takes so long; sometimes I have to get up and walk around, and sometimes I have to pee about 10 times."

Like Diane, Paula came home after surgery with a catheter and it was removed three weeks later. "What will happen when I am 60 or 70 and I can't go at all, will I have to wear a catheter permanently?" Just before having the surgery Paula heard about transvaginal mesh erosion horror stories, and she expressed concern to her gynecologist. "He said I didn't have to worry about it and to trust him because I was getting a newer model of mesh, the size of a band-aid.

"Now I can laugh and cough without worry; I'm not going to lie and say I have other problems going on, but this problem I have now is not natural and I don't know whether I should have this mesh removed. I do know that, given the information I have about transvaginal mesh since my surgery, I would never have had it in the first place."

The purpose of the drug was for the prevention of ulcers, but it has also been used in abortions. Brain damage to infants is of particular concern.\

         Studies recently published in the British Medical Journal, which concluded that women ages 15-44 taking birth control pills containing the synthetic progestin, drospirenone, are more likely to develop blood clots deep in the veins of the leg (venous thromboembolism), than women using birth control pills containing the common progestin levonorgestrel. Blood clots can move and if they end up in the brain or lungs can be deadly.

Topiramate has recently been combined with other drugs to battle obesity and bipolar disorder. More than 4.7 million prescriptions for Topamax were filled in the United States from 2007 to 2010, bringing in approximately $600 million worldwide last year.

         The .Long-Term use of Fosamax has been shown to more then double the Risk of Femur Fractures Among Older Women.
An article in an issue of the Journal of the American Medical Association reports that long-term use of Fosamax and other bisphosphonate drugs by older women more than doubles their chance of suffering femur fractures. This side effect is particularly disturbing in light of the fact that Fosamax and similar drugs are prescribed to strengthen the bones of women with osteoporosis.

It causes much less damage then traditional cautery devices and is associated with less bleeding than a scalpel.

Constipation
Constipation is most likely secondary to how the mesh is placed and not the material itself. Constipation typically occurs when the surgeon places a piece of mesh that is too small or too tight. This pushes down on the rectum and causes severe constipation.

Occasionally, there will be some stretching of the mesh attachment points and constipation will improve. However, when constipation persists beyond two months, Dr. Zipper recommends surgical correction of the mesh.

Surgical correction of mesh-related constipation is accomplished by cutting one or both of the high mesh attachment points. This is a simple outpatient surgery performed through the original vaginal incision. Although there is a risk of rectal injury, this is uncommon in the hands of a skilled surgeon.

Pain
Pain is the most difficult to treat. Pain most likely secondary to how the mesh is placed and not the material itself. Pain is typically caused by mesh being too small/tight or attachment of the mesh near the pudendal nerve. It is not uncommon to have rectal and groin discomfort for several weeks following surgery. The early use of anti-inflammatory agents such as Mobic as well as special stretching techniques are often helpful. Severe pain, pain persisting beyond two months, and/or pain radiating down the leg merits more aggressive intervention by the surgeon.

Surgical correction of pain is most successful when the pain is related to tension (the mesh being too tight and pulling on the muscles and ligaments of the pelvis). Under such circumstances, the surgeon may open the original incision and cut the high attachment points of the mesh. This often leads to an immediate resolution of rectal pain, groin pain, and pain radiating down the leg. Although there is a risk of rectal injury, this is uncommon in the hands of a skilled surgeon. In cases where the mesh is not under tension, treatment of pain can be difficult. These patients may benefit from injections of the pudendal nerve and/or surgical release of an entrapped pudendal nerve. The later is performed by only a handful of surgeons across the U.S.

 According to Florida Today, an estimated 30to 50 percent of women older than 50 experience some type of pelvic organ prolapse, a condition in which pelvic muscles and tissues become weak, allowing organs such as the uterus or bladder to drop. In about 10 percent of such cases, symptoms are severe enough to impact quality of life.

The women interviewed by Florida Today all said their doctors promised repair with transvaginal mesh was the answer to their problems.

“She said it would be wonderful, and I’d feel like a new person,” Dorothy Vogt, now 74, said of her doctor.

Vogt underwent her surgery in October 2009. But when her pain got worse, a second doctor “cut away some of the mesh on an outpatient basis,” which didn’t help, she told Florida Today. Today, Vogt can’t exercise or pick up her grandchildren, and suffers from constant bladder infections.

Charlene Reinhardt, 69, tells a similar story. Her pain worsened after her surgery, and it was found that the mesh had eroded into her rectum and lower abdomen. In a second surgery, doctors removed what mesh they could, but Reinhardt still experiences pain.

Months after Patti Stalnaker’s 2008 surgery, she developed numerous infections under the mesh. She too underwent another procedure to remove mesh, but her pain continues. Stalnaker told Florida Today that even though she suffered from pelvic organ prolapse, her quality of life was better before she underwent her initial surgery with transvagninal mesh.

Lisa Smith, the youngest of the group at 46, told Florida Today that her transvaginal mesh surgery, it was as if she was “walking around with the equivalent of barbed wire inside me,” because of mesh erosion. Despite additional surgeries, she too remains in pain. The incontinence the mesh was supposed to fix has only become worse; she has lost her job and her health insurance.

Unfortunately, the stories these women told are not unusual. The U.S. Food & Drug Administration (FDA) first issued a warning for transvaginal mesh complications in 2008. Then just last month, the agency issued a second warning, stating complications associated with transvaginal mesh products used in pelvic organ prolapse repair are not rare. In the latest warning, the FDA said it had received more than 2,800 complaints about transvaginal mesh complications since 2009. Of those, more than 1,500 were associated with pelvic organ prolapse repair, and three involved fatalities. In September, the FDA is scheduled to hold an advisory panel meeting to debate whether transvaginal mesh devices should be required to undergo more testing.

Dozens of lawsuits are currently pending against the makers of transvaginal mesh. The four women interviewed by Florida Today are plaintiffs in a complaint involving about 300 women in 34 states.
